Terms of Service
Last updated: 2026-10-16
These terms form the agreement between posfactori (—, —) — "we" — and the business that creates a posfactori account — "you". By creating an account or using the service you accept them on behalf of your business. The service is offered to businesses only, not to consumers.
1. The service
posfactori is a cloud point-of-sale and restaurant management service: register, kitchen display, online ordering, reservations, inventory, staff, reports and the related integrations described on our website. We may improve and change features over time; we will not remove a core function of a paid plan during your current billing period without offering a pro-rata refund.
2. Your account
You must give accurate information and keep it up to date. You are responsible for everyone you add to your account (owners, managers, cashiers, kitchen staff, drivers, accountants), for keeping passwords and PINs secret, and for everything done under your account. Tell us at once at [email protected] if you suspect unauthorised access.
3. Trial, plans and payment
New accounts start with a free trial. After the trial, paid plans are billed in advance, monthly or yearly, at the price shown when you subscribe, plus VAT where applicable. Payments are processed by Stripe. If a payment fails we will remind you; if it stays unpaid for 14 days we may limit the account to read-only until it is settled. Prices may change with at least 30 days' notice, effective from your next billing period. You can cancel at any time; the plan stays active until the end of the period already paid, and amounts already paid are not refunded except where these terms or the law say otherwise.
4. Payments to you
Card payments you take from your guests (online payment links, card terminals) are processed by the payment provider you connect — Stripe, Viva Wallet or SumUp — under that provider's own terms with you. We are not a party to those payments and do not hold your funds. Refunds you issue are sent to the provider that took the payment; some payments (for example those received outside the system) must be refunded by you directly.
5. Your responsibilities
You are responsible for:
- the prices, taxes, allergens and other information in your menu;
- your legal obligations as a business, including issuing fiscal receipts. Where we offer an integration with a tax authority (for example AADE myDATA in Greece), it helps you meet that obligation but does not replace your own responsibility to check that documents are issued correctly;
- the personal data of your guests and staff that you store in posfactori — you are its controller, and our Data Processing Agreement applies;
- using the service lawfully and not attempting to break, overload, reverse-engineer or gain unauthorised access to it.
6. Your data
Your business data belongs to you. You can export orders, reports, customers and accounting data at any time. After you close your account we keep your data for 90 days so you can change your mind or export it, then delete it, except records we must keep by law.
7. Availability and support
We aim for high availability and announce planned maintenance in advance where possible. The register keeps working offline for cash sales and syncs when the connection returns. Support is provided by email at [email protected] on business days.
8. Liability
The service is provided with reasonable skill and care. To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data that you could have exported, and our total liability in any 12-month period is limited to the fees you paid us in that period. Nothing in these terms limits liability that cannot be limited by law, such as for fraud or wilful misconduct.
9. Suspension and termination
You may close your account at any time from Billing or by writing to us. We may suspend or close an account that breaches these terms, endangers the service or other customers, or remains unpaid, after notice where reasonable.
10. Changes to these terms
We may update these terms. We will tell account owners by email at least 30 days before material changes take effect. If you do not agree, you may cancel before they apply.
11. Law and disputes
These terms are governed by the laws of Cyprus. The courts of Cyprus have jurisdiction, without prejudice to mandatory rules that apply to you.
